The NBA legend Tells Court He Felt No Fear of the Racing Body in Legal Battle

The basketball icon, introducing himself formally in a Charlotte court on Friday, admitted that his drive to win and novelty within the sport emboldened his effort with 23XI Racing to confront Nascar over perceived violations of antitrust rules.

Financial Stakes and a Will to Win

Jordan shared financial and corporate details of his racing venture, saying he put in $40 million of his own funds into the Nascar Cup series team co-founded with business partner Curtis Polk and driver Hamlin.

“It fell to someone to act,” Jordan said in the Charlotte courtroom. “As a newcomer, I had no fear. I felt I could challenge Nascar as a whole. From my perspective, the sport it needed to be looked at from a different view.”

Central Issue: Charter Agreements and Renewal Demands

The heart of the case involves the end of a 2016 agreement where Nascar granted each team a franchise. This system mirrors other major leagues with independent franchises, such as the NBA’s Hornets or the NFL’s Panthers. The agreement was due to end in 2024 when Nascar insisted on teams renew their charters.

Jordan was on the witness stand for an hour and left the court to a media frenzy, with onlookers and reporters vying for a glimpse or a picture of the sports legend.

Leading the Legal Charge

Jordan’s 23XI is leading the full-court press along with Front Row Motorsports for Nascar to change a business model Jordan contended is breaking the law to maintain excessive control.

At issue for Jordan and a fellow team representative, who preceded Jordan, are details from last September. Gibbs described a frantic and emotional six hours where the sanctioning body told teams they must sign a charter agreement extension. The document spanned 112 pages outlining team compensation and a guaranteed entry in every race.

Choosing Litigation

Jordan explained that 23XI and Front Row Motorsports decided their only feasible option was to refuse a signature that 112-page package and litigate the matter. All other teams signed the agreement.

Jordan and co-owner Denny Hamlin reached out to Nascar about possible changes or negotiations. Nascar wasn’t talking, Jordan said.

The Ultimate Motivation: Victory

Ultimately, the resistance against what he saw as a unsustainable system was driven by the familiar goal for Jordan: Success.

“Denny convinced me adding a third car boosted our odds of winning,” he testified, sharing that he bought a third charter last year for $28m amid the legal dispute. “So I dove in.”

Gibbs described her request for permanent charters, which she said a written letter to Nascar. She said the timing of the contract signing demand didn’t sit well.

She said, Joe Gibbs first tried to call and persuade Nascar against forcing signatures, but Nascar’s leader declined the request.

“Don’t do this to us,” Heather Gibbs said Joe Gibbs told Nascar’s leadership. The response was, “Whether I have 20 charters, I have 20. If there are 30, I have 30.”
